Where liability cannot be entirely excluded by law, fry49's aggregate liability to any User for any single claim or series of related claims shall not exceed the greater of (a) PKR 1,000 or (b) any amount paid by the User directly to fry49 in the 12 months preceding the claim — noting that fry49 does not currently charge Users for access to the Platform.
These Terms shall be governed by and construed in accordance with applicable law. Where local mandatory consumer-protection or gambling-regulation law applies in the User's jurisdiction of residence, those mandatory provisions will take precedence over any conflicting provision in these Terms.
Pakistan-specific notice: fry49 acknowledges that online gambling is subject to significant restrictions in Pakistan under the Prevention of Gambling Act, 1977 and other legislation. These Terms do not constitute an endorsement of, or invitation to, online gambling activities that may be restricted or prohibited under applicable Pakistani law. Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties. Where resolution cannot be achieved through negotiation, disputes shall be submitted to binding arbitration or the competent courts of the jurisdiction applicable to the operator, in accordance with then-current applicable rules.
fry49 reserves the right to amend, update or replace these Terms at any time without prior notice, by publishing the revised Terms on the Platform with an updated "Last updated" date. Material changes will be highlighted where reasonably practicable.
It is your responsibility to review these Terms periodically to stay informed of any changes. Your continued use of the Platform following the publication of revised Terms constitutes your unconditional acceptance of the updated Terms. If you do not accept the revised Terms, you must immediately cease all use of the Platform.
If any provision of these Terms is found to be unlawful, void or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
No failure or delay by fry49 in exercising any right or remedy under these Terms shall constitute a waiver of that right or remedy. A waiver of any breach of these Terms shall not operate as a waiver of any subsequent breach.
These Terms, together with the Privacy Policy and any additional policies published on the Platform, constitute the entire agreement between you and fry49 with respect to your use of the Platform and supersede all prior agreements, representations and understandings.
